Wellstone and Lanier Golf Course Owners Announce intent to File $100M Lawsuit

In a letter hand delivered to the Forsyth County Board of Commissioners on Ocober 4th, Wellstone Communities and Lanier Golf Course notified the county of its intent to file a claim in Forsyth County County Superior Court.

According to the letter, Forsyth County commissioners "arbitrarily and capriciously" denied Wellstone's application for rezoing the 172 acre golf course to allow for the redevelopment of the property.

In the letter, Wellstone states:

"The Fifth Amendment to the Constitution of the United Stages, and Art 1, Sec. III, Para 1 of the Georgia Constitution provide that private property shall not be taken or damaged for public purposes without just and adequate compensation being paid.  You are hereby notified pursuant to O.C.G.A. 36-11-1 of  Wellstone and Lanier's demand that the county reconsider and approve their application and/or pay damages fo the diminution in the value of the Property incurred as a result of the taking of the Property.  These damages are in excess of $100,000,000.00 based on the value of the property at its highest and best use."
