The City of Cumming had their day in court Wednesday, and emerged successful in their bid to have SPLOST VI stopped, potentially ending a long standing 1 percent sales tax earmarked for future road improvements in the county. The decision results in approximately $190 million in lost revenue to the Forsyth County, and the City of Cumming.
Voters approved the SPLOST extension by a wide margin in the February election, but City of Cumming officials argued that the distribution and handling of the SPLOST funds was unfair. The city further argued that, according to the laws the govern SPLOST, projects must be explicitly stated on the ballot.
This decision effectively cancels the SPLOST extension, and if maintained, will result in a rollback of sales tax from 7% to 6% in Forsyth County in July.
Below is a list of road improvement projects that are affected by this decision:

This is disappointing news. Those that were in touch with this and actually read the law sort of knew this was going to happen. At times the above the law attitude and sales pitch swayed us, but in the end it seems like the law has spoken.
Maybe this should be a wakeup call to all involved that the price of being stubborn, and in some cases not so forthright, is very high. I think all of you (and especially one very loud, outspoken individual) should be ashamed.

Short lesson, Marc; the judge ruled that we actually FOLLOWED the law on this one, and he created one ruling out of nothing to award the injunction.

I think the voters were deceived. I thought that all along and that is why I was against SPLOST. That is why I spoke out against SPLOST.

Patrick Bell warned us this would happen. But David Richard called him a liar and arrogantly pointed out ad nauseum where, he said, Patrick's argument was wrong.
As it turned out, Patrick was right. Richard was wrong.
It was David Richard who led us down this primrose path. The city will be laughed out of court he said. If the city attorney thinks he can win this case then the city needs a new attorney he said.
No matter how hard David Richard tries to spin it, this was a devastating loss for Forsyth County. It has cost us tens of thousands of dollars in legal fees and could cost us half a billion dollars if we lose the Taubman Centers.
Now Richard wants to spend tens of thousands more on an appeal that is destined to fail. Why? Because the court ruling dealt the death blow to his ill-fated campaign for re-election
I hope those of us who oppose this absolute disgrace for county commissioner will parade to the Administration Building for the next regular meeting snd speak out during the public forum to demand that there be no appeal to this ruling.

I'm not ruling out the possibility that the Ga. Supreme Court will rule in the County's favor.
The BOC appointed a committee only after the City filed a lawsuit. They published a list of projects 19 days before the election. But, nonetheless, they did it. I don't think they would have done that if the City had not filed a lawsuit. The BOC were covering their behinds so to speak.
I don't think the county was given fair notice as to how the SPLOST money will be spent. Some voters always vote for SPLOST to keep their property tax low. But SPLOST is for "special purposes" and it is "optional." But, two members of the BOC threatened property tax increases unless the voters approved it. A large chunck of the $130M bond will go for incentives for Taubman Mall.
Actually, boys and girls, we probably won't be appealing this ruling, as having ALL the judges rulings in place help this county out far more than having the one ruling overturned.
It is called strategic thinking.

The only thing I can think of Dave, is the county will be better off if you put the SPLOST vote on the July ballot. That way the county only loses about two weeks of sales tax. Taking it to the Supreme Court could mean, it might not be put back on the ballot until November if the Supreme Court rules against the County. So, the first option is the better and safer choice. The judge didn't rule that you MUST negoiate with the City for another agreement. So, the City doesn't gain anything. I wasn't hoping the judges ruling would help the county gain some openness and honestly from the BOC. But, the jokes on me, I guess.

I read in today's newspaper all the comments from the Commissioner about appeals, etc. All the gloom about losing all these projects...ones he resisted by the way. GA SPLOST LAW
Proposed projects, time period, and maximum dollar amount to be raised for all projects must be listed on the ballot.
The language on the ballot must be specific enough to provide fair notice to voters as to which projects will be funded.
*Look at the list in the above article. On the top list, I see a dollar amount, but I don't see a time limit. On the bottom list, I don't see a dollar amount or a time limit. Also, it doesn't say which road projects are to be funded with bond debt and which aren't. I think this is the very same list provided for voters before Feb. 5, 2008.

This is what I am tripping on….the Savior…I mean commissioner states on his website as well as in the local media, the county is going appeal and it should be an easy over-turning ruling by the GA Supreme Court. Remember, he said his preferred direction would have the county appeal this ruling and then plan on another vote in November. Then, in an above post, he says, BOYS AND GIRLS (like we are his children), the county would not be appealing on the side of STRAGIC THINKING! So my questions are…Is the county going to appeal like you said or is the county not planning to appeal like you said? Bell was right and you were wrong!! You owe him an apology!! Lets all hold our breath!

Mr. Bell was, as usual incorrect. As you folks continue to ignore the realities staring you right in the face, the county's only loss was the overturning of the election. We WON on 4-5 specific legal points (depending on if you combine a couple).
After further review, I like the ruling exactly as it stands. It forces counties in the future to provide a list of projects at the time of the resolution being passed, and it will give the cities flexibility to fund whatever projects they can afford given the monies they get.
And it gives counties much, much, much more control over SPLOST, and that is codified in a legal decision since Wednesday.

The SPLOST vote was thrown out. But no one will ever be able to convince you that you lost and Ford Gravitt won.

The judge didn't rule that you MUST negoiate with the City for another agreement. So, the City doesn't gain anything.
GA. SPLOST LAW:
If municipalities are involved, their names and their projects must also be identified.
A Retired Superior Court Judges cannot sit on the bench in Forsyth County and re-write Ga. Law. If so, then there is certainly grounds for appeal on either side. If either side thinks the judge misinterperted the law, then there are grounds for appeal to a higher court. That is how our legal system works.

How do I know that for a fact it will 'pale in comparison'. How about putting up some hard cold facts. How much is it costing us an hour for the counties' legal team on this matter. How much is it for trial time, etc. How many hours have we paid out already on this legal matter-- now that is something you certainly can provide a definite answer in factual form. Can you give me a dollar amount of how much money we have spent in legal fees as a county on this particluar legal endeavor. I think the people need to know that for sure. I have changed my mind on whether we should appeal. I suspect the board (without any vote having yet been taken) probably won't appeal. But that is just a guess on my part. I have as much ability to predict what is going on in their minds as I have in yours. Therefore, I have no idea what an appeal would cost. But it would be safe to say that legal fees are likely in the thousands, while the benefits to the county are in the millions to NOT appeal.

This county is living in a fool's paradise. The county is facing a possible almost $7million budget deficit. The country is going into a recession. Gas prices and food prices are rising by the minute while the dollar is in free fall. Home foreclosures are at a record high in the metro Atlanta area. In the paper last week you were quoted with the same comments but more detail. Then all of a sudden you changed your mind. Is that not similar to other people that changed their mind? Or was it a lie when you said it would go to the court of appeals. I ask because you never said you changed your mind until you were confronted with the flip-flop.
So, I just wonder if your own rules regarding lies applies to you as well as everyone else or do you have a different set of standards when it comes to yourself?

DM: Mr. Richard I politely asked you to retract your libelous statements about me owing Forsyth County any legal bills. Now you mention Milum v. Kreager where the County was entirely removed from that case at the very first motions hearing. The County has no dog in that hunt and hasn’t had one for many years as the County was released from any involvement.
I suppose that now, as a Forsyth County Commissioner, you now want to place the County back in that hunt. This is perfectly acceptable to me Mr. Richard. So be it. Expect to see a libel lawsuit with your name and that of Forsyth County if you do not retract you libelous statements today.

The water intake allotment statement was a lie and you know it. You prove otherwise. Or should I say when it does not happen in the month or two you stated at the meeting we will know it is a lie. You said we were going to split the water withdrawal permit. This close if I remember. Oh yeah, no need to remember, it's on audio right here on this site. Link at the end of this post.
You popped off at the mouth all through that article about the water issues. You finally end up saying that the county asked for a split of the permit, you don't know when the decision will come down and your are not the EPD and don't make those decisons.
All that was said because you were not being truthful. You knew it was a lie when you said it at Smart Growth. You never anticipated it being recorded and when the audio came up you could not dispute it. So you want to challenge the valididty of Mr. Bell's sources to take the focus off your lies.
Make it easy for us and really prove him wrong. Call the mayor and his staff and post those answers right here. Ask all Commissioners and post those answers right here. Ask the County Manager and Water Dept. Manager and post that right here. Although you will say you are so busy and all that. I think too scared to do it. Ya know, I have been asking questions of him for a while on these message boards. I am one of the people that he refers to as an idiot. I was even sent what I would consider a harassing email from him to my home email address. He has insulted me many many times. IMHO, everytime he posts some of his rants, he loses supporters. I hope people realize that he makes no distinction who he insults.. Men, Women.....perhaps maybe even children I don't know. I have never received a straight answer. Never. And I am one of the people who happen to have agreed with him on the Mr. Smith issue long ago. But he still says in public forums that I am an idiot.
