On Friday of this week, the Forsyth County News ran an ad paid for by the “Cumming Forsyth Tax Relief Committee” which shows the depths to which this committee will stoop in order to sell their campaign of lies and misinformation to Forsyth County voters.
The ad liberally uses quotes from my personal website, taken without my permission, and uses them completely out of context in order to convince voters that I am against the SPLOST VI tax referendum. In no place in that ad do they reference the fact that I was talking about a school system SPLOST, and not the most well-researched, best-justified SPLOST referendum in the history of Forsyth County; namely the SPLOST VI referendum currently in front of Forsyth County voters.
I want it clear to everyone who reads this article on cumminghome.com, the one unbiased news source in Forsyth County, that I am 100% in favor of renewing the penny tax as specified in SPLOST VI.
This despicable attempt to use my own words to defeat something that I wholeheartedly agree with is not surprising, given some of the members of that committee. But to have the name of what once was a respected judge in this county putting his name on such a dishonest ad is a crying shame. That the editors of the Forsyth County News would print that ad without verifying the truth of the ad is also not surprising, as the rules they state for members of organizations they agree with do not apply for organizations or individuals they do not agree with. Any competent news organization would have had the decency to call the person being quoted in the ad and asked if the statements were true; the Forsyth County News never called me. Yet they allowed the use of my words without permission to be printed in their sorry excuse for a newspaper.

The administration of this county needs to learn to work with the money that we already give them. Drumming up some hot topics to sell the idea that we need to give them additional tax dollars is bordering dishonest. We seldom get the opportunity to reduce taxes and we should not let this one go to waste.
Tell me, Mr. Bush, how do we go about fixing over $700 million in infrastructure improvements without extending a one-penny sales tax that has been in operation for years and has been responsible for fixing hundreds of much-needed projects across the county?
If we took 100% of the property taxes we currently collect for county operations it would take is over 7 years to complete those much-needed projects, but we would have no money to pay the people who would be responsible for doing the work.
But if you want to support people who deliberately lie in order to get their point across, then feel free to do so. I personally wouldn't be associated with any of them.
It seems to me that when anyone has another ansewer to a problem commissioner Richard defends the negative part of what is going on.
Commissioner Richard is a know it all and has done NOTHING for this county except confuse the real problems at hand.

I have made three motions regarding property tax rates since becoming commissioner. Two were made to REDUCE the millage rate; one was to MAINTAIN the current millage rate.

You have hit the nail on the head and put it in a nutshell. I can't vote to turn over a boat load of money to....JUST PLAIN STUPID!
This year we will have the opportunity to elect 3 new members to the board.
In a year, maybe we can get some problems solved and vote for SPLOST.
Here is a list of the projects on the "A" list. Most of them say engineering and right-of-way acquisition. Does that mean the projects will be compeleted with SPLOST VI? It doesn't sound like it to me. The contingency for the upscale mall says "construction." Most of them don't.

While I can normally find some fault in most all politicians track records Commissioner Dave Richard’s has to be one of the best I have experienced. Without his hardworking contributions, alongside “the other two” in controlling runaway growth, our infrastructure future would be much gloomier that it already is.
I have also found that Commissioner Richard has some of the same problems as I do, in that he is drop-a-big-rock-on-his-toe, brutally honest, so honest in fact that some see him as painfully arrogant. Albeit, what I have noticed with particular interest, is his ability to separate truth from fantasy. He accomplishes that by his logical deduction of the outright lies from the truths, such as this newest SPLOST proposal. Forsyth County is well known for its corruption and judicial dishonestly and now we have added the dishonesty of City Government to boot.
As a businessman said to me one hour ago; “this place has gotten so bad that I am moving my family from here. It is now totally out of control. When it gets to the point that we can’t even trust our judges and District Attorneys Office this tells me enough is enough. I am settling my affairs here and I’m gone. This is not a fit place to raise a family or run a legitimate business”.
I asked the man if he saw our dilemma as pure evil and answer; “yes I do”. I told the man about a statement that was attributed to Superior Court judge Jeff Bagley; “the people that were not raised here have no respect for those that were. They need to be taught respect for us.” Bagley allegedly made this statement while under the umbrella of a religious setting in Silver City, Georgia. Bagley was often heard saying; “what would Stan do”? I’ll stop there and let you finish that thought for those of you who know both people.
As I have stated before; I have little to no patience for stupidly and working ‘against’ a one percent sales tax to benefit this county’s needs is plain ole stupid. Further defending those who came up with such a idiotic idea to punish our county by way of the childish temper tantrums of the City Mayor and some of his supporters further insults the intelligent of those of us who know what this is all about, which is; the City losing its longstanding stranglehold on Forsyth County’s Citizens.
Uncontrollable growth? Some officials looked at it as economic enhancement while the good ole BOYS held back all of the commercial entities to economically match the growth. Take a look at The Avenues of every other county and it took us how long to gain this high end development that would most definitely appease those that moved to FC for reasons of low taxes and good schools. The good ole boys held back the economic growth of commercial real estate - while those in FC went to Fulton of Dawson to shop. I say for anyone willing to shake up the good ole boys such as the Judge, has my vote and I am not for standing on the side of those that have who have a road named after them.......SHAKE AND BAKE to remake THIS CITY!! Bring it into today's time - not yesteryear!
Cumming is like many other small towns in America. The big box chain stores put the mom and pop stores and businesses out of business and changed the character forever. Yes, we tried to resist the growth, but nobody could stop it. My family has a road and a park named after them. But, now we are called the good ole boys and yahoos.

You created a market for homes in this county by moving here in droves. You bought homes on small lots in subdivisions and now want to steal land from other people for 'Greenspace," to look at.

Embarrassing as the article is and how it is so disrespectful to the school system...It's amazing the similarities between the position of Cumming Forsyth Tax Relief and Dave...different SPLOSTs but amazingly similar positions.
I think that a public servant that authors a public website that addresses his stance on public issues it (the website) becomes open to any and all that read it. It is not copyrighted work and is out there for any and all to see, read and quote. At least the ad gives the exact URL where the entire rant can reviewed.
So all’s fair as far as I can see. Both sides have used quotes from the other in this whole process. Yet only one starts calling “foul”.
Reminds of a little kid I once knew that would take his toys and go tell his mommy if he did not win the game.
Folks, this is the type of representation you have. I hope in July you will think twice before sending him back to represent you.
I moved here in 1999 and had the opportunity to move "home" in 2001. We decided to stay here because this is truly a great county. I cannot think of a better place to raise a family. I am proud to have met many of these old-timers and love the down to earth attitude and good old family values.
So all you old-timers stay the way you are and stand firm. You are what give Forsyth County its character!

First, if you look back at my comments regarding "yahoos" I was referring to the rumor-mongering folks spreading a lie about me at Mr. Swiss. Sorry of you can't understand that. I've met some of the smartest people I know who were born and raised here. I've also met some folks who are dumber than a sack of hammers. Sadly, Georgia has no exclusivity claim on that. But most of the ones I've met here still have a chip on their shoulders regarding a war that was fought and lost 140 years ago. So before you go complaining about the term "yahoo", which I use for every person who is dumber than a sack of hammers (since it takes less time to say), try removing the negative quality people born here have with the term "Yankee", and then we'll talk.
Two, Charlie Laughinghouse knew I was very upset with him and his handling of the Shawn Scott issue. I did not stab him in the back. That a private e-mail from me to another county employee would be made public was unfortunate, but as far as I am concerned, Charlie and I have settled our differences and remain friends.
Three, proof (and I know that proof is something you know very little about) shows that Gary Smith was called to Washington, D.C. to testify before Congress. When you are one of the most respected election officials in the state and perhaps the nation, and you are more familiar with electronic voting machines than most everyone else, you go to Washington to testify before Congress when they ask.
Of course, this was all explained in simple english to everybody on my website (www.davidrichard.info) - The Gary Smith File, about a month ago. Maybe you are a bit behind on your internet reading. Its a little long and may bore you, but it presents the facts about Gary Smith.

Poor ol' David! A county commissioner for three years and he hasn't figured out yet that there is no such thing as a "private email" when it is written and sent on a taxpayer-owned computer.
As far as stabbing Charlie in the back, only King David would see it any other way. But that pales in comparison to the fact that David once proclaimed that hiring and firing should be the responsibililty of the county manager and that no comissioner should have any say in the matter. I guess he meant nobody but him should have a say in the matter.
Don't worry. My prediction is that King David will receive less than 35% of the vote in his re-election bid.

Since the Impact Fee Administrator/Special Projects Co-ordinator position reported to the Board of Commissioners, I had every right to have a say in that matter. You, of course, wouldn't know this, but I have had almost no involvement in hiring the CFO or Deputy County Manager, and have even spoken about not requiring any, since the positions report to the County Manager (even though she's asked for my opinion).
You wouldn't know any of this, because you are no longer employed by the county, and can never be re-hired because of your actions.
Keep trying, Bill. Oh, you'll keep failing, because that is all you do; but keep trying nevertheless.

When a county manager brings a candidate for either of those positions into an executive session that I am attending, I don't really have much of an option but to hear that person out, now do I? Personally, given the makeup of this board and the less than unanimous vote to put her in that position, she might feel the need to have some acceptance from the board regarding her choices for these important positions. Needless to say, I listened and said my piece to her about not needing my input for their hiring. Sorry that you have failed again to score any points against me. I remain consistent, as always.
And I guess I should have learned from your experience about personal communications and county computers. Certainly, running someone's campaign from your own county computer should have told me that there are people within our county departments that find a way to find both illegal actions (yours) and innocent actions (mine) and make them public.
You remain a thoroughly discredited source of any knowledge regarding government function, or of my actions. Pathetic doesn't even begin to describe your lack of understanding.
Please explain specifically what law you mistakenly believe was broken. Last time I checked faxing a copy of a press release was not illegal.

Courts in this country have ruled that information sent to or received by taxpayer-owned computers is a matter of "public" record. Richard knows this to be true and yet, he continues to mantain the emails he sent to Shawn Scott on a taxpayer owned computer is "private."
Folks, David Richard is stating a fact that he knows to be untrue. Pure and simple, he is what he accuses so many others of being -- a liar!

By law those emails are a matter of public record. David Richard knows this, yet he continues to refer to the Shawn Scott email as "private." There is simply no other way to say it. David Richard is lying.
Commissoner Richard, I have read all your comments about suing citizens and backing a voter registrar that looks suspect about spending our taxes without oversight. Even after a professional company, Bates and Carter reported activity that is suspect and borderlines theft.

The long answer to your question is that e-mails are always subject to any citizen asking to see them via an Open Records Request. A citizen can ask for "all" e-mails from a county employee to another county employee, or from a county employee regarding a specific subject, or they may ask for "all" e-mails, period. To do the latter would incur substantial time and money for both the county and the requestor, so that option is never used. Most people fine-tune their requests down to something more manageable.
Does that make all e-mails "public"? In the broad definition of the word, yes; it does.
However, in the case of the Shawn Scott e-mail that Bill Johnson keeps harping on, that e-mail was not gleaned from a request for "all" e-mails from me to Shawn Scott, nor was it provided as part of a request for any e-mails from me with Charlie Laughinghouse as the subject.
Only two people should have known about that e-mail; Shawn Scott and me. As such, the case could be made that it was a "private" e-mail. Clearly, neither one of us had any reason to disclose the contents of that e-mail.
However, someone else in that building knew the contents of that e-mail, because someone else in that building has been reading commissioner's e-mails for some time now. There had only been a suspicion regarding that, and other commissioners had taken steps to handle all e-mail through personal e-mail addresses that cannot be spied upon.
The release of that e-mail was designed to hurt three people; Shawn Scott, Charlie Laughinghouse, and me. No other purpose could be served by the release of that e-mail except to harm others. We don't know who did it, and we aren't trying to find that person, because we don't play that kind of game.
But that act has caused all commissioners and other officials to keep their opinions about subjects to themselves until we can discuss them in private one-on-one conversations, or within the rules of executive session. That makes government more closed and secretive, and that is something that should never happen.
We now have a political climate that favors "gotcha" over accomplishment, and sadly we have people working in our building who would rather sell-out their elected officials for personal or monetary gain.
This is a dead subject as of right now.

By the way, when King Richard states that to request "all" emails to/from a particular commissioner would incur a substantial expense to both the county and the requestor, he is lying again.
The commissioner knows perfectly well that the county can charge the requestor for the material produced and the time a county employee spent in locating the documents. So don't let him deceive you as he has so many times in the past.

I have no problem with answering questions, completely and clearly, unless you don't understand the english language (just like Bill here). I get defensive when people lie about me or my stances and I get defensive when people accuse me of doing something without knowing one darn thing about the process of government (again, like Bill).

Everybody at the site knows Darwin in really David Richard and they have called him on it repeatedly. Of course he denies it, but there is absolutely no doubt which makes yet another lie he has told.

Good question, David. As I look back on your performance in office, I'd say there is no limit to how many times one person can be wrong.
I take no special pleasure in seeing just how wrong you have been because you have damaged Forsyth County and hurt many good people who didn't deserve to be hurt.
But there is one thing I am happy to see you be wrong about and that is your chances for re-election. You're not quite smart enough to know it, but you have totally self destructed.
If a Republican candidate doesn't step forward to challenge you, then Jon Flack will be the first Democrat elected in Forsyth County in years.

Actually if you read the local blogs -- and we know you do, Darwin -- the majority opinion seems to be that you are a liar. That may not mean much to you as a private citizen. But, then, you're no longer a private citizen. You are an elected official. And you will soon find out how important that majority opinion can be.

How about this little factoid, Bill? I checked, and on that website filled with negativity, I come out literally 50-50 in a poll on whether I should be re-elected. On a site that specializes in negativity!
I'll worry about every vote until the last one is counted. What I'm NOT going to do is worry about any prediction from you.

I fired more people during my years of success and progress. You and your friends only caused many to loose their jobs because of your selfish moritorium on this county.
