County Responds to Court's Decision On Pine Lake Dam Remediation

On Monday, May 9, Forsyth County Chairman Jack Conway and the Board of Commissioners gave legal counsel the go ahead to consult with an engineer regarding refined pricing for the remediation of Pine Lake Dam. The directive was such that a cost estimate could be returned to the Board of Commissioners.

The county is currently obtaining an estimate on the cost of repairing the dam and replacing the road. Once the cost estimate is received the county will ask the permission of the Board of Commissioners to proceed.

This action was prompted as a result of the Georgia Supreme Court affirming a decision by the Forsyth County Supreme Court. Judge Langford, sitting via designation, ruled that the county has at least partial responsibility for repair of the dam and replacing the road.

Although the county vigorously defended this matter in an effort to exercise stewardship of the county purse and save taxpayer dollars, they at this point have decided to proceed as instructed in light of the Supreme Court affirmation.
